By using the Clarity Standards platform, including viewing inspection checklists, uploading photographic evidence, generating compliance reports, or scheduling inspections, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms apply to all users, including tenants, landlords, property managers, and any other person or entity accessing the Service.

If you are accessing the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these terms.

2. Permitted Use of the Service

You agree to use the Clarity Standards Service only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of the Service. Prohibited behavior includes:

• Harassing or causing distress or inconvenience to any person or entity;
• Obscene or offensive language or content;
• Disrupting the normal flow of dialogue within the Service;
• Uploading or transmitting false, misleading, or fraudulent inspection documentation or photographic evidence;
• Attempting to gain unauthorized access to the Service or its systems;
• Using the Service for any illegal purpose or in violation of applicable rental, property, or tenant protection laws;
• Reverse engineering, decompiling, or attempting to derive the underlying code or methodology of the platform;
• Removing, obscuring, or altering any copyright, trademark, or proprietary notices;
• Selling, reselling, or commercially exploiting access to the Service without authorization.

Clarity Standards reserves the right to suspend or terminate access to the Service for any user who violates these permitted use restrictions.

3. Intellectual Property Rights

All content on the Clarity Standards platform, including but not limited to inspection checklists, diagnostic methodologies, photographic templates, written guidance, layout, design, graphics, and software code, is the exclusive property of Clarity Standards or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business purposes related to rental property inspection and cleaning documentation. This license does not permit you to:

• Copy, modify, or create derivative works based on the Service or its content;
• Distribute, publish, or transmit any content from the Service;
• Use the Service's inspection criteria, checklists, or methodologies for competing commercial purposes;
• Frame or mirror the Service on another website or application.

Photographic evidence and inspection documentation you upload remain your property, but you grant Clarity Standards a non-exclusive license to store, process, and display this content within the Service to fulfill its diagnostic and compliance functions.

4. User-Generated Content and Documentation

You are responsible for all photographic evidence, inspection notes, and other content you upload or submit through the Clarity Standards platform. By uploading content, you represent and warrant that:

• You own or have the right to use and authorize the use of all content you submit;
• The content is accurate, truthful, and not misleading;
• The content does not infringe any third-party intellectual property, privacy, or other rights;
• The content complies with all applicable laws and regulations, including Italian rental and property law.

Clarity Standards does not endorse or guarantee the accuracy of user-generated content. You acknowledge that inspection documentation uploaded to the platform is intended to support compliance discussions and dispute prevention, but does not constitute legal advice or a binding determination of property condition.

5. Disclaimers and Limitations of Liability

The Clarity Standards Service is provided on an "as-is" and "as-available" basis. Clarity Standards makes no warranty, express or implied, regarding the accuracy, completeness, reliability, or fitness for a particular purpose of the Service, its content, or any information derived from it.

Clarity Standards does not warrant that:

• The Service will be uninterrupted, error-free, or free from harmful code;
• Defects in the Service will be corrected;
• The Service will meet your specific requirements or expectations;
• Use of the Service will prevent deposit disputes or guarantee favorable outcomes in rental disagreements;
• Inspection checklists or photographic evidence will be accepted by all landlords, property managers, or legal authorities.

Limitation of Liability: To the maximum extent permitted by law, Clarity Standards shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, or loss of deposit funds, arising out of or related to your use of the Service, even if Clarity Standards has been advised of the possibility of such damages.

In no event shall Clarity Standards' total liability exceed the amount you have paid to Clarity Standards in the twelve months preceding the claim, or €50 if you have not made any payment.

Some jurisdictions do not permit the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

6. No Legal or Professional Advice

The Clarity Standards platform is a diagnostic tool designed to document cleaning standards and prevent deposit disputes through detailed inspection checklists and photographic evidence. The Service does not constitute legal advice, financial advice, or professional consultation regarding rental law, tenant rights, or landlord obligations.

While the inspection criteria are informed by rental property standards and Italian rental law principles, Clarity Standards does not guarantee that compliance with the platform's checklists will resolve disputes or satisfy all landlords or legal authorities. You should consult with a qualified legal professional regarding your specific rental situation, deposit recovery, or rights and obligations under applicable law.

7. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Italy, specifically the laws of the Lombardy region, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

You agree that any dispute, claim, or controversy arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Milan, Italy. You consent to the personal jurisdiction of such courts and waive any objection to venue or inconvenient forum.

8. Changes to These Terms

Clarity Standards reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service following the posting of revised terms constitutes your acceptance of the changes. It is your responsibility to review these terms periodically for updates.

If a change is material and adversely affects your rights or obligations, Clarity Standards will make reasonable efforts to notify you via email or through the Service. If you do not agree to the modified terms, you must discontinue use of the Service.

9. Termination of Service

Clarity Standards may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to:

• Violation of these Terms of Service;
• Uploading false, fraudulent, or misleading inspection documentation;
• Harassment or abuse of other users or Clarity Standards staff;
• Illegal activity or violation of applicable law;
• Non-payment of fees, if applicable.

Upon termination, your right to use the Service ceases immediately. Clarity Standards may, at its discretion, retain or delete your account data in accordance with its Privacy Policy and applicable data protection law.

The Clarity Standards Service may contain links to third-party websites, resources, or services that are not operated by Clarity Standards. These links are provided for convenience only. Clarity Standards does not endorse, control, or assume responsibility for the content, accuracy, or practices of third-party sites.
